TERMS OF USE: WELLNESS UNION

1. Scope and Agreement

These Terms govern the use of Wellness Union (wellnessunion.co.za), a free, independent guide to yoga and Pilates studios in Cape Town operated by Lank Chilled (Pty) Ltd ("Lank Chilled", "we", "us"). By using the website you agree to these Terms.

These Terms supplement the Lank Chilled (Pty) Ltd Master Terms of Service, which continue to apply. Where these Terms and the Master Terms differ, these Terms take precedence in respect of Wellness Union. The Wellness Union Privacy Notice explains how personal information is handled.

2. What Wellness Union Is

Wellness Union shows each listed studio's published prices and booking policies in one consistent format, with the source of each fact and the date it was last checked, so that people can compare studios before they commit.

Wellness Union does not take bookings or payments for classes, does not publish reviews, and does not grade or rate studios. It is independent and not affiliated with or endorsed by any studio.

Listings are never for sale. Studios never pay to be listed, and no payment, from a studio or anyone else, changes a studio's listing, its position in results, its prices and policies as shown, or its price and other indicators.

3. Information on the Website

Listings record what each studio publishes on its own website, booking page or Instagram, or has sent us in writing (shown as "provided by the studio"). Where a studio does not publish something, we say "Not published"; this does not mean the studio fails that term. Records that have not yet been checked by a person or confirmed by the studio are marked "Not yet verified".

Comparisons are calculated, not judgements. A price indicator compares a studio's drop-in price with the average drop-in price of listed studios offering the same class type, and the typical cancellation window is the middle value of the windows listed studios publish. How each is calculated is set out on the website's About page.

Studios may change their prices and policies at any time, and we cannot guarantee that every listing is complete, accurate or current. Always confirm prices and terms with the studio before you book or buy. Your agreement for any class, pass or membership is with the studio, on the studio's terms.

4. Studios

A studio may confirm or correct its listing at any time, through the private link we email to its published address or by emailing hello@wellnessunion.co.za. Changes a studio sends are checked before they are published; where a change has no public source, it is shown as provided by the studio.

By sending us information about its prices, policies or contact details, a studio confirms that it is accurate and allows us to publish it on its listing.

Studio names and trademarks belong to their owners and are used only to identify the studios listed. Short excerpts of studios' published policies are quoted, with their source, to show exactly what each studio says.

A studio's published prices and policies are information about the business, and its listing may remain on the website. On request, we will remove personal contact details (such as a named person's email address or mobile number) from a listing and stop emailing the studio.

5. Corrections

If you believe a listing is wrong, tell us at hello@wellnessunion.co.za, with a link to the studio's current information where you can. We will check the source and correct the listing where needed.

6. Acceptable Use

You must not:

  • use Wellness Union unlawfully, or to harass, mislead or impersonate a studio or any other person
  • submit false information about a studio, through the suggestion form, a studio's private link or otherwise
  • copy listings in bulk, or scrape the website by automated means, to republish them elsewhere
  • attempt to access reviewer areas or private links that are not yours, or to disrupt or probe the website

7. Links to Other Websites

Listings link to studios' own websites, booking pages, Instagram profiles, maps and messaging services. These are run by others under their own terms and privacy policies, and we are not responsible for their content or for any booking or purchase made through them.

8. Fees and Paid Options

Wellness Union is currently free to use, for visitors and for studios, and no fees are charged.

We may in future offer paid options, for example advertising on the website, or a licence for a studio to use the Wellness Union badge in its own marketing. Paid options will always follow section 2: they will never change a studio's listing, position or indicators, and advertising will be clearly labelled as advertising. A studio may use the Wellness Union name or badge only under a licence from us. The terms and fees of any paid option, including how the Lank Chilled Cancellation and Refund Policies apply to it, will be set out before anyone pays.

9. Intellectual Property

Wellness Union, its name, badge and logo, software, design, presentation of listings, indicators and compiled information remain the property of Lank Chilled. Information a studio publishes about itself remains the studio's.

Suggestions and feedback may be used to improve Wellness Union without obligation.

10. Availability

We aim to keep Wellness Union available and accurate, but it depends on third-party providers and the internet, and we do not guarantee uninterrupted availability. We may change, add or remove features and listings.

11. Limitation of Liability

Wellness Union is provided free of charge and for information only. To the extent permitted by law, Lank Chilled is not liable for any loss arising from reliance on a listing, including a price paid, a booking made or a fee charged by a studio, or for indirect or consequential loss.

Nothing in these Terms limits liability that cannot be limited by law.

12. Changes to These Terms

We may update these Terms. The current version is always on the website, with the date it was last updated.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

MASTER TERMS OF SERVICE

1. Introduction

These Terms of Service ("Terms") govern the use of all digital products and services operated by Lank Chilled (Pty) Ltd ("Lank Chilled", "we", "us", "our"), including but not limited to LinkDoc, Modulo, Unitbase and Wellness Union.

By accessing or using any of our products, you agree to be bound by these Terms and any applicable product-specific terms.

2. Eligibility

You must have the legal capacity to enter into a binding agreement to use our services.

Certain products may impose additional eligibility or verification requirements, which will be disclosed within those products.

3. Product-Specific Terms

Some products operated by Lank Chilled are subject to additional or separate terms, notices, or policies.

Where product-specific terms apply, they take precedence over these Terms in respect of that product.

4. Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use our services for lawful purposes in accordance with these Terms.

5. User Responsibilities

You agree to:

  • Use the services lawfully and ethically
  • Provide accurate and current information
  • Maintain the confidentiality of your account credentials
  • Comply with all applicable laws, professional rules, and regulations
  • You may not impersonate any person, professional, organisation, or entity, or misrepresent your identity, credentials, or affiliation.

6. Intellectual Property

All intellectual property rights in our services remain the property of Lank Chilled or its licensors.

No rights are transferred except as expressly stated.

7. Payments and Billing

Fees, billing cycles, and cancellation terms are disclosed within each product.

Users outside South Africa may be billed in South African Rand or a foreign currency.

Currency conversion rates, foreign exchange fees, and local taxes are the responsibility of the user unless explicitly stated otherwise.

8. Suspension and Termination

We may suspend or terminate access where there is misuse, legal non-compliance, breach of these Terms, or risk to the platform or its users including suspected impersonation, fraud, misrepresentation, or risk to users or the platform.

9. Platform Intermediary Position

Lank Chilled operates its products as neutral technology platforms and intermediaries. We do not create, control, or endorse user content except where explicitly stated.

10. Disclaimers

Services are provided on an "as is" and "as available" basis, to the maximum extent permitted by law.

11. Limitation of Liability

To the extent permitted by law, Lank Chilled is not liable for indirect, incidental, or consequential damages.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa.
